Terms & Conditions

These Terms govern every booking, project and retainer with DCS Real Estate ("DCS", "we", "us"). Please read them carefully before booking a shoot.

1. Acceptance of Terms

By booking a shoot, signing a proposal, making a payment, or otherwise engaging DCS Real Estate for any video production service, you ("Client") agree to be bound by these Terms & Conditions in full. If you do not agree with any part of these Terms, you must not proceed with booking or using our services. These Terms apply to individual agents, brokerages, developers and any other party engaging DCS.

2. Our Services

DCS provides property video production services including, but not limited to: cinematic listing films, drone and aerial footage, CGI off-plan renders, 3D virtual tours, agent UGC content, social media reels, community and lifestyle films and before/after renovation reveals. Exact scope, formats and quantities are defined in the applicable package, proposal or invoice agreed with the Client.

DCS reserves the right to determine the appropriate equipment, crew, editing approach and creative execution required to fulfil a booking, unless otherwise specified in writing.

3. Booking & Property Access

  • All bookings are confirmed only once a deposit (where applicable) has been received and a shoot slot has been allocated by DCS.
  • Client is responsible for ensuring safe, legal and timely access to the property at the confirmed shoot time, including any permissions required from landlords, tenants, developers, or building management.
  • Where drone footage is requested, Client confirms the property and surrounding airspace are suitable for licensed drone operation. DCS's drone crew retain final discretion to cancel or reschedule aerial capture on safety or regulatory grounds.
  • If DCS's crew arrives at the confirmed time and is denied access or the property is not ready for filming, this will be treated as a late cancellation under Section 3 of our Refund & Cancellation Policy, and the full package fee remains payable.
  • Rescheduling requests must be made at least 48 hours in advance and are subject to crew availability.

4. Payment Terms

All prices are quoted in AED unless otherwise stated. Unless a different arrangement is confirmed in writing, DCS requires full or partial payment prior to the shoot date, with any remaining balance due before final files are delivered. Retainer clients are billed monthly in advance; access to that month's deliverables may be paused if payment is overdue.

Late payments may incur a reasonable administrative fee and DCS reserves the right to withhold delivery of raw or edited files until outstanding amounts are settled in full.

5. Revisions & Delivery

Each package includes a defined number of revision rounds, as stated in the applicable proposal or pricing page. Revision requests must be submitted in writing within 5 business days of delivery; requests submitted after this window or beyond the included revision count, may be billed separately.

Delivery timelines (e.g. 24–48 hour turnaround) are targets, not guarantees, and may be affected by weather, site access delays, or other factors outside DCS's reasonable control. DCS will communicate any expected delay as soon as it becomes known.

6. Intellectual Property

  • DCS retains full ownership of all raw footage, project files, drafts and unused material produced during a shoot, unless expressly transferred in writing.
  • Upon full payment, Client receives a non-exclusive, worldwide licence to use the final delivered edited videos for their own marketing, listing and promotional purposes.
  • DCS retains the right to display any delivered work in its own portfolio, website, social media and marketing materials, unless the Client opts out in writing prior to delivery.
  • Client warrants that any music, branding or third-party material they request be included is properly licensed for use; Client agrees to indemnify DCS against any claim arising from Client-supplied material.

7. Limitation of Liability

DCS does not guarantee any specific marketing outcome, including but not limited to inquiry volume, sale price, sale speed, engagement or lead generation resulting from delivered content. Video is one factor among many in a property's marketing performance.

To the maximum extent permitted by law, DCS's total liability for any claim arising from a booking is limited to the amount actually paid by the Client for that specific booking. DCS shall not be liable for any indirect, incidental or consequential loss, including loss of profit or loss of a sale opportunity.

8. Force Majeure

DCS shall not be held responsible for delay or failure to perform any obligation due to causes beyond its reasonable control, including but not limited to severe weather, drone airspace restrictions, government regulation, power or internet outages, illness or other events of force majeure. Affected bookings will be rescheduled at the earliest available opportunity at no additional cost to the Client.

9. Termination

DCS may suspend or terminate any booking or retainer, without refund of amounts already earned for work performed, in the event of non-payment, abusive conduct toward crew or staff, or provision of false information regarding property access or ownership.

Client-initiated termination is subject to the notice periods and forfeiture terms set out in our Refund & Cancellation Policy.

10. Governing Law & Disputes

These Terms are governed by the laws of the United Arab Emirates and where applicable, the laws applicable in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation and failing resolution, shall be referred to arbitration administered in Dubai, with the seat of arbitration in Dubai, UAE.

11. Changes to These Terms

DCS may update these Terms from time to time to reflect changes in our services, pricing or legal requirements. Continued use of our services after an update constitutes acceptance of the revised Terms. Material changes affecting active bookings will be communicated directly to the Client.
